Fla. Lawmakers Introduce LTCI Change Bill

Lawmakers in Florida have introduced companion bills that could keep new laws and regulations from affecting some long-term care insurance (LTCI) policies.

The bills are S.B. 1306, which was introduced by Sen. Garrett Richter, R-Naples, Fla., and H.B. 1053, which was introduced by Rep. Larry Metz, R-Eustis, Fla.

The bills would affect the continuation or renewal of a guaranteed-renewable LTCI policy.

If a guaranteed-renewable LTCI policy were continued or renewed, then a renewed policy would not count as a new policy or contract “for any purpose,” and the renewed status “would have have the effect of incorporating into the policy or contract statutory or regulatory changes that were enacted or adopted after the original issuance date of the guaranteed-renewable policy,” according to the bill text.

If enacted and implemented, the provision would take effect July 1, 2012.
