High Court Rejects Disability Evidence Case

The U.S. Supreme Court has declined to take up Lynn Jewell vs. Life Insurance Company of North America.

The case, which came from the 10th U.S. Circuit Court of Appeals, centered around the evidence presented during a “de novo,” or “from scratch,” review of group disability insurance decision.

A trial court let a claimant present evidence that was not presented to the insurer when the claimant initially filed the claim.

The appeals court overruled the trial court and said that, even when a trial court reviews benefits decisions de novo, it should try to rely mainly on the evidence that the parties were using before they went to court.
