Self Insurance Group To Lobby For ERISA Preemption

A group that represents self-funded employer health plans has released a collection of legislative proposals.

The Self-Insurance Institute of America, Washington, says initiatives it wants to promote include containing costs, offering small employers new health insurance tax breaks, supporting health plans that incorporate personal health accounts, and encouraging small employers to team up to buy health coverage.

The SIAA also is promoting protection for the provision in the Employee Retirement Income Security Act that preempts state regulation of large and midsize group health insurance plan.

“The broad preemption provision of ERISA enables employers to offer health benefits that are consistent among employee groups anywhere in the U.S. rather than being subjected to conflicting and inconsistent state and local regulations,” the SIIA says.

Congress should preserve ERISA, the SIIA says.
