Jeffrey W. Evans writes: Vivian P. Gallo makes some good points in her article in the September 2008 issue of LTC e-Wire (Long term care insurance a part of divorce settlements? Yes).

An idea that I have used also concerns the divorce issue but relates specifically to pre-nuptial agreements and long term care insurance. Regardless of what the pre-nup says, if the poorer spouse needs care, the one with the money will have to dig in and pay for it.

I try to get in front of the attorneys with this issue and have found that they have no problem discussing it and including it in the agreement.
