The regulation affects employers that administer their own benefit plans and employers that have partially self-funded benefit plans as well as health care organizations, the companies note.

The authors are Gary Clayton, founder of Privacy Council, a privacy compliance consulting firm, and Philip Gordon, a partner in the Denver office of Littler Mendelson, a law firm that specializes in cases involving employment and labor law.
